Recursie VoF (“Company,” “we,” “our,” “us”) is a Vennootschap onder Firma (VoF) registered in the Netherlands with the following details:

These Terms and Conditions apply to all transactions conducted through our webshop. By placing an order, you agree to the terms set out below.

All prices displayed on our webshop are in euros (€) and include VAT, unless stated otherwise. We reserve the right to update pricing and product availability at any time. Orders are binding upon confirmation, and payment must be completed before shipping.

We strive to deliver products within the estimated timeframe; however, delivery times are subject to change due to unforeseen circumstances. If a product cannot be delivered within 30 days, you have the right to cancel the order and receive a full refund, as per Article 7:46f of the Dutch Civil Code.

Right of Withdrawal (14-Day Cancellation Policy)

In accordance with Directive 2011/83/EU (Consumer Rights Directive) and Article 6:230o of the Dutch Civil Code, consumers have the right to withdraw from their purchase within 14 days of receiving the order without providing a reason. To exercise this right, you must notify us in writing via email at info@recursie.com within the withdrawal period.

Once the withdrawal is communicated, you must return the product within 14 days. The item must be unused, in its original packaging, and in a resellable condition.

Refunds will be processed within 14 days of receiving the returned goods and will be issued to the original payment method. If the returned item has been used or damaged beyond what is necessary to determine its nature and functionality, we may deduct an amount corresponding to the depreciation in value, in accordance with Article 6:230s of the Dutch Civil Code.

Chargebacks

If you initiate a chargeback and it is subsequently determined—after a thorough review in accordance with the Payment Services Directive (EU 2015/2366) and relevant provisions of the Dutch Civil Code—that the chargeback was illegitimate (i.e., initiated without proper grounds), you agree to pay a flat dispute resolution fee of €30. This fee is intended to cover the administrative costs. You acknowledge that this fee is not a penalty but a genuine pre-estimate of the administrative fees charged by Mollie.

Our total liability for any claims arising from or in connection with your purchase is limited to the purchase price of the product in question, except where liability cannot be limited by law. We shall not be liable for any indirect or consequential losses, including loss of profit or income, unless such liability is based on gross negligence or willful misconduct.

Warranty and Complaints

We adhere to Dutch consumer protection laws (Book 7 of the Dutch Civil Code), which grant consumers the right to a legal warranty. Only if a product is defective or does not meet reasonable technical expectations, you are entitled to repair, replacement, or a refund. Defects must be reported within one month of discovery. The legal warranty extends to 24 months after delivery of the product.

Complaints can be submitted via email at info@recursie.com. We aim to respond within 14 days. If a dispute arises and cannot be resolved directly, you may contact De Geschillencommissie (Dutch Consumer Disputes Board) or the Online Dispute Resolution (ODR) platform of the European Commission.

Liability

We are not liable for indirect damages, including consequential loss or loss of income, unless caused by gross negligence or intent on our part. Our total liability is limited to the purchase price of the affected product, in accordance with Article 6:190 of the Dutch Civil Code.

Privacy and Data Protection

We process personal data in compliance with the General Data Protection Regulation (EU 2016/679 – AVG in the Netherlands). Personal information is collected only for order fulfillment, customer service, and legal compliance. For more details, refer to our Privacy Policy.

Governing Law and Dispute Resolution

These Terms and Conditions are governed by Dutch law. Any disputes will be subject to the jurisdiction of the competent court in Amsterdam, NL, unless EU consumer protection laws mandate another forum.

Changes to Terms and Conditions

We reserve the right to modify these Terms and Conditions. Updates will be published on our website with an effective date. Continued use of our webshop implies acceptance of the revised terms.
